1. Acceptance of Terms

By installing, accessing, or using FindForce.io ("Service"), including our browser extension and website, you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you must immediately discontinue use of our Service.

2. Service Description

FindForce provides email verification and validation services for publicly available professional contact information. Our Service helps sales professionals verify email format accuracy, deliverability, and professional contact quality to improve outreach effectiveness and protect sender reputation.

IMPORTANT: This is a verification service, NOT a data extraction or scraping tool.

3. User Responsibilities and Platform Compliance

YOU ASSUME COMPLETE AND SOLE RESPONSIBILITY for compliance with all applicable laws, regulations, and third-party platform Terms of Service, including but not limited to LinkedIn, Facebook, Twitter, and other social media platforms.

By using FindForce, you explicitly acknowledge and agree that:

  • Platform Compliance: You are solely responsible for compliance with LinkedIn's User Agreement and all other platform Terms of Service
  • Legal Compliance: You will comply with all applicable laws including GDPR, CAN-SPAM, and data protection regulations
  • Permission Requirements: You will obtain all necessary permissions before contacting any individual
  • Independent Research: You will conduct your own research to verify contact information accuracy
  • Policy Changes: Platform policies change frequently; you are responsible for staying informed and compliant
  • No Liability Transfer: We provide no assurance that tool use complies with any platform's policies

4. Acceptable Use Policy

You agree NOT to use FindForce to:

  • Violate any platform Terms of Service (especially LinkedIn's User Agreement Section 8.2)
  • Send spam, unsolicited communications, or engage in harassment
  • Collect information about individuals under 18 years of age
  • Violate any applicable laws or regulations including data protection laws
  • Use automated methods beyond the intended functionality of our Service
  • Attempt to reverse engineer, decompile, or extract our source code
  • Resell, redistribute, or create derivative works from our Service
  • Use the Service for any unlawful or fraudulent purposes

5. Liability Transfer and Indemnification

FULL INDEMNIFICATION CLAUSE:

You agree to defend, indemnify, and hold completely harmless FindForce, its officers, directors, employees, contractors, agents, and licensors from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to:

  • Your use or misuse of the Service
  • Your violation of these Terms or any applicable law
  • Your violation of any third-party platform Terms of Service (including LinkedIn)
  • Any content, data, or contacts you process through the Service
  • Any outreach or communications you send using verified information
  • Any claims of spam, harassment, or unwanted communications
  • Any data protection or privacy law violations

6. Data Protection and GDPR Compliance

User as Data Controller:

When using our Service with personal data, particularly from EU residents:

  • You act as the independent data controller
  • You must have a valid legal basis for processing personal data (legitimate interest, consent, etc.)
  • You are responsible for providing appropriate privacy notices to data subjects
  • You must honor all data subject rights requests (access, rectification, deletion, etc.)
  • You must implement appropriate technical and organizational security measures
  • You warrant that you have all necessary rights to process the data through our Service

7. Account Terms and Security

  • You must provide accurate and complete account information
  • You are solely responsible for maintaining account security and confidentiality
  • You must notify us immediately of any unauthorized account access
  • One account per individual or legal entity
  • Account credentials may not be shared or transferred

8. Payment Terms and Billing

  • Subscription fees are billed in advance on a monthly or annual basis
  • All payments are non-refundable except as required by applicable law
  • We reserve the right to modify pricing with 30 days' written notice
  • Free tier limitations and features may change at our sole discretion
  • Overdue accounts may be suspended without notice

9. Service Limitations and Disclaimers

NO WARRANTIES OR GUARANTEES:

FindForce provides email verification services on an "AS IS" and "AS AVAILABLE" basis. We make NO warranties or representations regarding:

  • Accuracy: Verification results are confidence scores, not guarantees
  • Completeness: No assurance that all available data is captured
  • Platform Compliance: No guarantee that use complies with third-party platform policies
  • Deliverability: No guarantee that verified emails will be delivered
  • Legal Compliance: No assurance of compliance with applicable laws

10. Intellectual Property Rights

  • FindForce retains all intellectual property rights in the Service
  • You retain ownership of your data and contact information
  • You grant us a limited license to process your data solely to provide the Service
  • Our trademarks, logos, and branding are protected intellectual property

11. Privacy and Data Handling

Your privacy is governed by our Privacy Policy, incorporated by reference. By using the Service, you consent to our data collection, use, and sharing practices as described in the Privacy Policy.

12. Limitation of Liability

MAXIMUM LEGAL PROTECTION:

TO THE FULLEST EXTENT PERMITTED BY LAW:

  • Liability Cap: Our total liability shall not exceed the fees paid by you in the 12 months preceding the claim
  • Excluded Damages: We are not liable for indirect, incidental, special, consequential, or punitive damages
  • Platform Issues: We are not liable for any consequences of platform policy violations
  • Business Losses: We are not liable for lost profits, business interruption, or reputational harm
  • Force Majeure: We are not liable for events beyond our reasonable control

13. Disclaimer of Warranties

COMPREHENSIVE DISCLAIMER:

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY OR RELIABILITY, UNINTERRUPTED SERVICE, AND ERROR-FREE OPERATION.

14. Modifications to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email notification to registered users, prominent notice on our website, and in-Service notification.

Continued use after changes constitutes acceptance. If you disagree with modifications, you must discontinue use.

15. Termination

Termination Rights:

  • Either party may terminate at any time with or without cause
  • We may immediately suspend or terminate for Terms violations
  • We may terminate for suspected platform policy violations
  • Upon termination, all rights to use the Service cease immediately
  • Sections surviving termination: Indemnification, Limitation of Liability, and Governing Law

16. Governing Law and Jurisdiction

These Terms are governed by the laws of Estonia, without regard to conflict of law principles. Any legal disputes shall be resolved exclusively in the courts of Estonia. You consent to the personal jurisdiction of such courts.

17. Dispute Resolution

Before pursuing legal action, parties agree to attempt resolution through good faith negotiation for 30 days. If unsuccessful, disputes may proceed to binding arbitration or court proceedings in Estonia.

18. Severability and Force Majeure

If any provision is deemed invalid or unenforceable, the remaining provisions remain in full force and effect.

We are not liable for delays or failures due to circumstances beyond our reasonable control, including natural disasters, government actions, or technical failures.

20. Entire Agreement

These Terms constitute the entire agreement between you and FindForce regarding the Service and supersede all prior agreements and understandings.

ACKNOWLEDGMENT: By using FindForce, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. You understand that you bear full responsibility for platform compliance and legal obligations.
